Selamat datang di aplikasi milik PT XLSmart Telecom Sejahtera Tbk ("XLSMART"). Ketentuan Penggunaan berikut adalah ketentuan dalam penggunaan aplikasi milik XLSMART yaitu AXISNET dan aplikasi terkait lainnya (bersama-sama selanjutnya disebut sebagai "Aplikasi") serta penggunaan atas konten, layanan dan fitur yang ada di Aplikasi. Selain itu, ketentuan terkait kerahasiaan dan penggunaan data pribadi Anda diatur dalam Pemberitahuan Privasi yang terpisah dengan Ketentuan Penggunaan ini. Harap Anda membaca Ketentuan Penggunaan serta Pemberitahuan Privasi dengan sebaik-baiknya. Dengan mengakses dan menggunakan Aplikasi ini, berarti Anda telah membaca, memahami, dan setuju untuk terikat dengan Ketentuan Penggunaan, Pemberitahuan Privasi, dan semua peraturan yang berlaku di Aplikasi ini. Jika Anda tidak menyetujuinya,, maka Anda Anda tidak dapat dan tidak disarankan menggunakan Aplikasi ini.
XLSMART dapat setiap saat mengganti, menambah atau mengurangi Ketentuan Penggunaan ini. Anda terikat oleh setiap perubahan tersebut dan karenanya kami menghimbau Anda untuk secara berkala mengakses Aplikasi ini guna melihat dan memperoleh informasi mengenai Ketentuan Penggunaan yang berlaku dan mengikat Anda.
Setiap logo dan/atau aplikasi logo dan/atau merk atas layanan, konten, produk, dan fitur milik XLSMART sebagaimana terdapat di Aplikasi ini berada dibawah perlindungan hukum yang berlaku di Indonesia. Anda tidak dibenarkan untuk menggunakan, mengimplementasikan dan mengaplikasikan logo dan/atau aplikasi logo tanpa persetujuan tertulis sebelumnya dari XLSMART. Seluruh materi yang terdapat dalam Aplikasi ini dibuat oleh XLSMART, oleh karena itu XLSMART memegang hak cipta penuh atas materi tersebut yang diberikan dan dijamin oleh hukum yang berlaku di Indonesia termasuk namun tidak terbatas pada Undang-undang No. 19 Tahun 2002 tentang Hak Cipta. Apabila ada individu maupun badan hukum yang menemukan bahwa material yang terdapat dalam Aplikasi ini adalah miliknya, dapat segera menginformasikan kepada XLSMART dan XLSMART akan segera menghapusnya dari Aplikasi ini.
Dengan mengakses dan/atau berlangganan layanan, konten, produk dan fitur (selanjutnya disebut .Layanan.) yang terdapat di Aplikasi, Anda telah setuju untuk tunduk pada Syarat dan Ketentuan Layanan serta Anda telah setuju untuk menggunakan Layanan sesuai dengan ketentuan perundangan yang berlaku di Indonesia. Apabila Anda tidak ingin tunduk pada Syarat dan Ketentuan Layanan yang terdapat di Aplikasi ini, Anda dilarang menggunakan atau mengakses Layanan yang terdapat di Aplikasi ini. XLSMART setiap saat dapat mengubah Syarat dan Ketentuan Layanan dan perubahan ini akan berlaku pada saat perubahan tersebut diposting di Aplikasi. Dengan Anda menggunakan Layanan yang terdapat di Aplikasi berarti melahirkan perjanjian antara Anda dan XLSMART, dan Anda diwajibkan untuk mempelajari Syarat dan Ketentuan Layanan secara berkala dengan mengakses Aplikasi ini. Dengan ini Anda setuju untuk mempelajari Syarat dan Ketentuan Layanan di Aplikasi secara berkala dan dengan Anda tetap menggunakan seterusnya Layanan yang terdapat di Aplikasi merupakan bentuk penerimaan atas Syarat dan Ketentuan Layanan beserta perubahannya.
Penggunaan Anda atas Aplikasi ini harus tunduk pada hukum dan peraturan perundangan dalam wilayah Republik Indonesia. Anda menjamin bahwa Anda akan hanya menggunakan Aplikasi dan Layanan yang terdapat di Aplikasi sesuai dengan Ketentuan Penggunaan dan/atau Syarat dan Ketentuan Layanan dan/atau sesuai dengan ketentuan hukum dan perundang-undangan yang berlaku di Indonesia. Anda setuju untuk membebaskan dan/atau melindungi XLSMART atas segala tuntutan maupun, gugatan pihak lain mengenai namun tidak terbatas pada hal-hal yang mungkin terjadi sehubungan dengan (1) penggunaan Anda atas Aplikasi dan/atau atas Layanan yang terdapat pada Aplikasi; dan/atau (2) pelanggaran atas Ketentuan Penggunaan Aplikasi dan/atau Syarat dan Ketentuan Layanan yang terdapat pada Aplikasi ini. Pelanggan XLSMART yang telah melakukan pendaftaran untuk menjadi pelanggan Layanan dengan cara apapun (dengan mengisi formulir berlanggaran secara tertulis atau dengan pendaftaran secara elektronik), dengan ini menyatakan setuju dan tunduk pada ketentuan yang tercantum dalam Syarat dan Ketentuan Layanan tersebut.
Jika terjadi kehilangan, kecurian, dan atau penyalahgunaan SIM Card XLSMART, Pelanggan XLSMART wajib untuk segera memberitahu XLSMART. Pelanggan XLSMART akan bertanggung jawab untuk semua biaya yang menjadi tanggungan Pelanggan sehubungan dengan penggunaan SIM Card XLSMART, termasuk namun tidak terbatas pada semua biaya yang berkaitan dengan penyalahgunaan dan atau penggunaan untuk tujuan penipuan/tidak sah yang dilakukan oleh Pelanggan XLSMART dan/atau pihak lain
XLSMART berhak menurut kebijaksanaannya dan demi kenyamanan seluruh pelanggannya, untuk melakukan penangguhan atau pemutusan Layanan tanpa pemberitahuan terlebih dahulu atau ganti rugi terhadap Pelanggan, apabila hal-hal dibawah ini terjadi: Terjadi kerusakan secara teknis pada Layanan; Terdapat perbaikan, modifikasi atau pemeliharaan pada Layanan; Pelanggan melakukan pelanggaran terhadap Syarat & Ketentuan; Jika Pelanggan dan atau pihak lain, yang berdasarkan pertimbangan XLSMART akan mengakibatkan kerugian atau kerusakan terhadap XLSMART dan/atau terhadap Layanan; Apabila berdasarkan pertimbangan XLSMART, Layanan disalahgunakan untuk tujuan penipuan oleh Pelanggan dan atau pihak lain; XLSMART akan berusaha untuk melakukan tindakan secepat mungkin jika penangguhan atau pemutusan terjadi disebabkan oleh hal-hal yang dinyatakan di atas. Pelanggan akan bertanggung jawab untuk semua biaya yang dikenakan pada saat gangguan, penangguhan atau kerugian terhadap Layanan tersebut.
Layanan International Roaming diluar Indonesia tersedia di negara-negara tertentu. XLSMART berhak berdasarkan kebijaksanaan XLSMART untuk menentukan Pelanggan yang memenuhi syarat untuk Layanan International Roaming tersebut.
Seluruh informasi yang terkandung dalam Aplikasi ini adalah benar pada saat dimasukkan. XLSMART mempunyai hak penuh untuk mengubah informasi yang ada dari waktu ke waktu Ketidakmampuan atau kegagalan Anda dalam melakukan akses Aplikasi ini tidak dapat dijadikan alasan untuk menuntut, menggugat maupun mengklaim XLSMART apabila ada kerugian yang menimpa Anda Jika terdapat pengguna Aplikasi yang memberikan tanggapan atas informasi yang ada dalam Aplikasi ini, termasuk tetapi tidak terbatas pada pertanyaan, komentar, saran atau yang lain, maka hal itu dianggap sebagai sesuatu yang bukan rahasia dan XLSMART tidak mempunyai kewajiban apapun sehubungan dengan tanggapan tersebut serta XLSMART memiliki kebebasan untuk mereproduksi, menggunakan, memberitahukan atau membagikan tanggapan tersebut tanpa pembatasan.
Ketentuan Penggunaan ini beserta Syarat dan Ketentuan Layanan yang terdapat pada Aplikasi tunduk pada hukum yang berlaku di wilayah Republik Indonesia.
Aplikasi ini mungkin menyediakan link ke aplikasi pihak lain. Link dimaksud tidak memperlihatkan bahwa XLSMART menyetujui dan bertanggung jawab atas konten aplikasi pihak lain tersebut. XLSMART is the sole proprietor of the intellectual rights given and guaranteed by the law constituted in the Republic of Indonesia included but unlimited to the Decree No. 19 Year 2002 about Copyrights. If there is an individual recognition on the material within this Application belongs to him/her, that person is encourage to enlighten the information to XLSMART and XLSMART will terminate it immediately from this Application Terms and Condition of Services, Content, Product and Features within this Application ("Terms and Condition of Service") By accessing this and/or subscribing to our service, content, product and features (or is called . Services. for further reference) within the Application, you are agreed to conform with the Terms and Condition apply and you are agreed to use the Services as regulated by the law constituted by the Republic of Indonesia. You must conform to the law and decree constituted within the region of Republic of Indonesia when using this Application. You must guarantee that this Application is used only for the Application and Services stated within the Application referring to the Terms of Usage and/or Terms and Conditions of Service and Guidance of Services and/or with the law and decree applies. You are agree to release and/or to protect XLSMART from any charges, from other party but does not limit to other event relating to (1) Your using the Application and/or for the Services displayed within the Application; and/or (2) violation to the Terms of Usage of this Application and/or the Terms and Condition of Services stated within this Application. Registered XLSMART Customer to receive Services in any form (by filling the subscription form in writing or by registering electronically), hereby agree to conform to the term stated within the Terms and Condition of Services.
Your use of this application must comply with the laws and regulations in the territory of the Republic of Indonesia. You guarantee that you will only use the Application and Services contained in the Application in accordance with the Terms of Use and / or Terms and Conditions of Service and / or in accordance with the provisions of laws and regulations in force in Indonesia. You agree to release and / or protect XLSMART for all demands or claims of other parties regarding but not limited to things that may occur in connection with (1) your use of the Application and / or the Services contained in the Application; and / or (2) violations of the Application Terms of Use and / or Terms and Conditions of Service contained in this Application. XLSMART customers who have registered to become Service customers in any way (by filling in the infringement form in writing or by registering electronically), hereby agree and comply with the conditions stated in the Terms and Conditions of the Service.
Should there be loss, robbery, and/or violation of your XLSMART SIM Card, XLSMART Customer must report to XLSMART immediately. XLSMART Customer will be responsible for all the cost relating to the usage of his/her XLSMART SIM Card, including but not limiting to all the cost relating to violation and/or usage for the purpose of fraud/illegal act performed by XLSMART Customer and/or other party.
XLSMART has the appropriate right and for the purpose of general comfort for its customers to suspend and terminate the Service without prior notification or replacement for the Customer should these following events occur: Immediate action will be conducted by XLSMART should the suspension and termination are caused by the events explained as. Customer will be fully responsible for all the cost relating to the trouble, suspension or loss of the Services. Technical difficulty of Services; Upgrade, modification or maintenance of Services; Customer violate the Terms and Condition or When Customer of other party, after XLSMART consideration will cause loss or damage to XLSMART and/or the Services When after XLSMART consideration, Customer or other party violate the service for the purpose of fraud; XLSMART will try to take action as soon as possible if suspension or termination is caused by the things stated above. Customers will be responsible for all fees charged at the time of interruption, suspension or loss of the Service.
International Roaming Service outside Indonesia is available at selected countries. XLSMART has the appropriate right to determine which Customer is qualified to enjoy the International Roaming Service.
All information stated within this Application is correct when input. XLSMART owns the full right to upgrade the information from time to time. Your failure or incompetency to access the Application cannot be used as an excuse to file charges, demand, or claim XLSMART when you subject to discomfort. When Application user responds over information stated within this Application, including but not limiting to questions, comment or other issues, this matters will be considered explicit and XLSMART does not have the authority concerning the issues and XLSMART owns the freedom to reproduce, use, inform, or distribute the respond without provisions.
